AGREEMENT FOR HIRE OF EQUIPMENT FOR STANDARD TWO-DAY PERIOD

PARTIES

IVORY LIMITED trading as Magnus Hire (Owner)

(Hirer)

  • The Owner shall let, and the hirer shall take on hire, the VCANTER(S) (Equipment) specified in Schedule 1 of this Agreement for the agreed period.

  • The Hirer shall pay to the Owner by way of hire charge the agreed sum on entering into this Agreement.

  • (a) In addition to the hire charge the Hirer shall pay $2,000.00 (Deposit) to the owner on entering into this agreement, such sum to be held as a deposit in respect of additional charges and costs as provided for in cl 4 of this Agreement.

    (b) The Owner shall refund the full amount of the Deposit to the Hirer upon the Hirer returning the Equipment to the owner in good working order and in clean condition, within the Period of Hire. If the Hirer does not return the Equipment as required the Owner may deduct charges and costs due under cl 4 and refund the balance (if any).

  • (a) The Hirer shall maintain the Equipment in good working order during the Period of Hire and shall return the Equipment in the same conditions as at the start, clean and on time.

    (b) In the event the Equipment is returned late, not in the same condition or dirty the Hirer will be liable for additional hirer charges, or repair costs and/or cleaning costs.

    (c) These charges and costs may be deducted from the Deposit but are not limited to the amount of the Deposit.

  • The Owner shall not be liable for any consequential damage or loss suffered by the Hirer as a result of the Equipment breaking down during the Period of Hire. The Hirer will refrain from any act throughout the Period of Hire which may in any way prejudice, invalidate or result in the cancellation of any insurance policy effected over the Equipment.

  • The Hirer acknowledges receiving the Equipment in good working order and clean condition and acknowledges it is fit for the purpose for which the Owner lets it on hire.

  • Any time or other indulgence granted by the Owner shall not prejudice the strict rights of the Owner under this Agreement.

  • No provision, other than those which are mandatory, shall be implied by statute or at common law or otherwise into this Agreement against the Owner.

  • If the Hirer wishes to extend the Period of Hire a new agreement must be entered into with the Owner.
